dark seraph... you're almost right in that police won't come knocking at your door.
the way the agreement works is, you "buy" a kit from 1st party. What you ACTUALLY buy is the license to develop on said kit. First party can at any point request the kit back and as the person who bought the license you are then legally obliged to return it.
this is why selling them from developer to developer is difficult, as 1st party still has to transfer to the license over. That license is linked directly to the Mac address of the unit.
When a developer like EA Chicago closes (I was there btw) devkits can sometimes slip through the cracks. In effect what this means is that the IT dept didn't do their jobs properly (being laid off, who would) so didn't follow up on all assets. Eventually EA will and any kits not found will be hunted down.
so... if you have bought a kit from a source that was not first party expect at some point in the future that your kit will be reclaimed... with no remuneration.
