I think that MS will probably have a say in what can be released for the XBOX 360 XNA Kit. I mean, I don't think that MS will allow emulators espically since these are in a grey area. But a person could code an emulator written in XNA & distrubute the source code & any who wants it just has to buy into the XNA creator's club & compile the emu for your 360.
