EDIT: Forget to add, would there also be a difference if a bad kreon rip was uploaded to the HDD, compared to a good one? I think this might be the same as asking if security sectors/PFI/DMI/etc would matter in this case(as its not running from the disc).

Considering that the DVD drive firmware has to be modified in order to run a backup game i would say it is , almost a forgone conclusion that they added security relating to putting backups on your HDD , if the drive knows the games are burned and won't play them , we just change it so it will play them , then the system already knows that it is a burned game , it has just been told it is ok too play it. Detecting that over a network would be much more difficult than writing a program and adding it too the new dashboard , then sending the information to microsoft. I guess only time will really tell us.

I installed the new dashboard already. also I installed some games on the drive FIFIA 09, Gear of war 2, silent hill.  I had no problem playing games from the drive YEt!

Well no I'm not saying you'd have a problem playing the games, I'm sure you can.

I'm more concerned about detection.

Because Major Nelson gave out early NXEs to people, and there is a leaked full version out already, you just lose XBL functionality.

this would be flawed though. What happens if you have a ripped copy of a orignal you own for example that was ripped on a iextreme then you go and use your retail console and it will still boot up through the hard drive then. BAM banned its a flawed idea.
