I am not an expert or anything but from what I've seen on a number of forums you most likely can get banned that way, I wouldn't risk it.

If you put your hard drive on the Modded xbox and install the game, then put it back on the LIVE xbox, then you will probably get some error that the game wasn't installed on this xbox.
