Just got of the phone with xbox-support, they cant give any guarantee dat my new not modded xbox wil not be banned by recovering my gamertag from the banned one

This is the best topic. Ive wondered this exact same thing. I have no problem buying the retail versions of my favorite live games. Then playing offline games on the modded console. any dlc mainly has two licenses. one  console and one gamertag. any downloadble content should be able to be used for ur offline console. I see this as a way to have my cake and eat it to. I just dont see how they could ban u on the assumption ur still using a modded xbx. Seems that employing disc checks while not on live would be like big brother spying into ur house. totally understandable that  if ur hooked to live then they have the right to check. but beyond that i think its a slippery slope. to many variables. maybe you hooked up ur hard drive to someones modded console you didnt know about. how can they ban u for that. the main issue is using live functions with modified consoles witch breaches the tos of the  live contract. that is why ur console is still usable but live dissabled. im gonna try this after the new fw drops. this is how im gonna game from nolw on.

so iam got banned today    
got a legit copy of mw2 got 5 achievements  if i were to buy a unmodded 360 would the hdd from then banned 360 be useless now

Thanks so much for this topic!  I currently have a setup similar to the ones mentioned (1 modded arcade console - NEVER logged into live, never had ethernet plugged into it, and 1 legit retail Elite for online play).  So far, I've transferred the HDD back and forth a few times a day with no issues.

The only thing I'm weary off, is using the activate.iso.  This is very n00bish, but is any *other* data stored on the HDD?  I would hate to play using the activate.iso and have it transfer information to my legit console and it be banned.

Well I guess ill post this here since evidently starting a thread specifically about it is too close to this thread.

The thing I'm wondering about is copying the gamertag back and forward from an unbanned modded Xbox that never goes online to an unmodded one that does go on live. By this I mean copying the gamertag using a memory card and leaving the hard drives in their respective 360's. It was mentioned a few times but pretty much overlooked.

Basically the only way that you could get banned this way would be if Microsoft put code in the games to check the status of your firmware and save it to your gamertag file. I dont think that this is not possible but I feel like it would be a pretty shady move on Microsoft's part. Like I saw mentioned earlier, you could take your gamertag to a friend's house and not know their Xbox was modded.

I'm am hoping that they just stick to banning consoles that are modded and log on to live. I could understand if they put code in the games to check if your console was modded and block offline achievements but I think it would be a step too far if they banned every console the gamertag was copied back to.

Opinions are great but may be wrong.
(I would if I could but I accidently fried my dvd drive just when the bans started to happen, stopping me from logging on xbox live but forced me to come here for tips which may have saved my xbox from bans. thank you xbox scene!)

That would presumably work for banned consoles. So far nothing points that it would be necessary to get rid of the modded xbox if it's unbanned.

They can't "tell", but even if your new box was offline, the data on the hdd would be corrupted. This is the point of the disabling.

You're not saying if your xbox was banned or not.

If banned, it's normal. You should've research a bit to know your options.

If unbanned (which means possibly flagged), then we have to worry.

I've been telling the kamikaze idiots in the ABGX360 IRC channel this over and over. People kept saying "Your going to get banned anyway."

I appreciate the creation of this thread  because it made me realize that people still have sense.

Keep the modded and unbanned console for Single Player and new unmodded console for Multiplayer.

When moving HD from "Banned" Console to the "new" Fresh one, will ALL game svaes be corrupted or only the ones that have been accessd on the "Banned" Console?

Just wanted to add that my modded console was never banned.  It's an XBL virgin.  I used activate.iso last night, and I will plug up my HDD to my legit console and see what happens!  I may just be being paranoid, but if MS can detect firmware information on a HDD, that IS pretty shady.

**edit** From what I see, everything is working just fine.  I will continue to use my setup.   I'm just worried about the wear and tear of constantly unplugging and re-plugging my HDD.  =|
