Have him update his firmware to v1.5, or v1.51 or v1.6 and I bet he will be banned within hours or less.

so is it the change in firmware, or the way the newer type (Ixtreme) firmware reacts to MS ?

Well... at this point, if thats the case, i wouldnt think he effed up, i mean it worked for a really long time until now. If MS continues to try and find out how people are playing pirated games, as long as they can establish a connection to our console (xbox live), they will most likely find a way to detect it, its just a matter of time. And when it happens, something else will have to be invented. MS has the resources to do it, their employees are getting paid for it.
