you sound like your kids gonna turn out real good. the game is rated m, underage kids, should not be playing it, period. games like cod, induce aggresion, and e-thug attitudes, hence, not good for a young kid to be listening too. smart parents would realize that, and either not allow the kid to play it online or at all, or at the very least, not to have a chat mic. live is free range, ain't no one getting banned for talking shit.
here's an idea, they have this thing called mute. it's real new, i think they released it like, um, forever ago.
if some kid is singing into the mic or swearing, mute his ass, then he's gone forever. cod4/cod5 both allow you to quickly mute annoying players in game, but you can alway perma-mute with live.
no right thinking parent would allow their 9year old to play cod online, with a headset, and not expect them to hear some messed up shit. if your too lazy, or stupid to monitor your young kids activities while they are online in any fashion, guess what, your a shitty parent.
IF isn't lame, chances are, they will think it through, and probably only disallow party chat on the game modes that it seriously affects, like search and destroy. especially seeing as in the regular game modes like team deathmatch, you can talk to the other players in game from the grave anyways.

giving the developer control over this feature doesn't mean bye bye private chat, it jsut allows them to disable a feature that has the ability to be taken advantage off.
mw2 isn't gonna be 100% no party chat, i'm sure it will only be disabled for modes like search & destroy.
