All you can do is give it a try. If you're going to get banned, you're going to get banned regardless if you wait months to plug it in or not.

But a lot of people received their retail copies last week or the week before.

Well it was released in Europe on the 23rd, so perhaps those "people" your talking about live in Europe?

Microsoft also said that people playing legit copies early who got banned had to simply show Microsoft their bill and they would be unbanned.

Yes. But in xbox.com forums, in account suspension section, a few people told that really bought the game legally, and the moderators replied that the ban was permanent and will not be reverted.

They don't asked for the receipt or anything.

That's odd. The Director of Policy and Enforcement for Xbox LIVE, Stephen Toulouse tweeted this last week:

If you have obtained a legit retail copy early and were banned then you can get unbanned by providing them the receipt. If you were stupid enough to play a torrent copy early, well your screwed.

I saw that he told this, and I can say that Stepto was the one who answered that the accounts was permanent banned, and will not revert. This guy is a jerk and stupid, thinks he is the owner of xbox live. I cannot recover my banned profile, because I did a stupid thing and tried to recover it. With this, I couldn't acess it even for offline play.

I asked this jerk how to recover it, because I have the rights to use it offline, and he told me that I CANNOT recover it, even for OFFLINE use.

    If so, would deleting game save from early released copy prevent ban? Or are they 'tagging' accounts by other means than through game save data?

the early ntsc release IS a retail copy. m$ was simply banning for playing the game before it was released, and thats all.

Which is very shady. If they really are banning for simply playing early, then there are going to be a lot of gamers who got the game legitimately and are being banned for doing nothing wrong. I've been battling with the suspension forum to get my gamertag unbanned, but it seems I will have to file a complaint with the Federal Trade Commission to have them investigate this. I urge everyone else to as well, as this is terrible business ethics.

The DComics release is indeed retail. 100% match in ABGX.

Not sure if this will help much, but after playing the torrent release early(PAL Release) WITHOUT the xbox being connected to live. I have still not been banned. I played it about 4 days early maybe 3? Without the ethernet lead connected and after i heard of the bannings i left it unconnected till after released. Connected it back up and still no ban.

Not sure if this helps but i noticed someone asking about it.
