Do you have a hard drive or memory unit? As long as the profile is stored on one of the two then you would have your profile AND saves. If not then yes you can recover the gamertag from Live, you just wont have the saves. Put simply, the Xbox console itself is banned, not the hard drive or accounts.

I have a hdd. So I could take my drive off the banned one plug it into the new and my gold account would work fine on the new system.
