If you have it on a legit unmodded 360 you should be fine, but if you mod it again and play backups, all bets are off because were still unsure of the actual decetion methoid M$ is using for the bans.

So with that being said then for a machine to meet the banning criterea it must have to tick more than one box i.e. having a gamertag with pre release achievements alone wont get you banned, but that along with another no no will?

Now if mem serves me correvt teh 360 has no battery backed up clock?

SO if you power down via mains its does not know the time untill you connect to live. or you set it.

So in throry you could power dwn console properley remove ya hd and use ya mem card to save any game u want to play beofore the games has been released.

Least that way theres no eveidence on your HD that the game has been played BUT when you do go back onto live after the ga,e has come out you can then shift all the game achivements to your live account.

And rem the 360 has no idea what times was clocked up when u got the achivements.

Your gamertag is fine, it will never be banned. It is the console only, you are free to take your hard drive out and put it in another console and xbox live works perfectly fine.  Hope that helps.

after all there is a package from M$ to copy your data from a small 20 gig hdd to a 120
so they have allowed you to migrate your date legally from one console to another, there fore you should be by defacto logic fine, now having said that, this is M$ we are talking about, and well sometimes they are just plain GOOFY!!  
Prevailing logic says gamer tag an id is safe, just not your modded console
