every drive has a certain number that matches your 360 console.  so you will need to have your original firmware.  i wouldnt worry about the ban, its either going to happen or it isnt.  if you flash it back, youre still going to get banned if you were on the list.

I don't think they're detecting firmware, I think they're detecting bad ISO's.  So don't leave backups in the drive while the network cable is plugged in.
