Buying Modded Xbox 360 From Craigslist -- Safe For 360?

Seems like the games he has listed are from a year or so ago...

Assuming his xbox 360 has not gotten banned from live, will I be alright with using xbox live (with properly patched games or original copies) with a flashed drive on the system?

(It's probably older flashed firmware method since the 360 is not brand new and he's had it for a while)..

Like, will I be alright updating to the latest dash since xbox live probably requires you to use the "latest and greatest"?
