As long as your 360 copies are stealthed (which scene releases are), and you have the latest firmware for your dvd drive then your fine. I have both and i've been playing copies online for quite awhile and haven't been banned.

Just make sure you don't sign in to xbox live when playing a early release game which isn't out in the shops.
