Been Banned, Can I Use Gamertag And Live With New Console?

Hi , I have searched the forums and cant seem to find much info specifically on this.

I was banned in the December wave and was wondering if i buy another xbox that is unhacked etc can i use my old gamertag and live account? I remember reading something about your console being banned not your account, is that true? Any additional info i might need?
