Not looking to get rich because they are in their 20s and 30s and college educated?  So only the poor are the ones who sue, is that what I'm hearing???

And thanks, you three idiots -- because of you, now the rest of us are in the dark about their efforts to get it working correctly.   Because you can afford to have an X360 and XBLive you feel that having it work all the time the way it's supposed to is a right.  And I'm sure Microsoft is doing this on purpose just to piss you three off, because what better way for them to drum up business than by making sure it doesn't work right.

No, I don't like having to pay for their service, but it's something I'm willing to pay for, and don't expect to be perfect.  They will have times they need to do updates and maintenance and whatever.  And they have been good about compensation in the past when things go wrong (they were gonna give a free game for our troubles, but you three probably fucked that up now too.)

You've got to be fucking kidding me.  And people wonder why other countries hate us.  Why don't you three take the time you now have since you can't get onto your precious game service and donate it towards helping out at a homeless shelter or at some charity event?  Why?  Because you're a bunch of selfish, spoiled little bastards who expect everything to go your way 24/7, that's why.

taco bell - didn't get the sour cream i paid for on my chili cheese burrito - $5 million
best buy - didn't get any batteries with my camera - $5 million
energizer - the batteries i bought for my camera only took 6998 pictures instead of estimated 7000 - $5 million
mc cabes bar - bought a chick a drink and didn't get laid - $5 million
honda of america - don't get the advertised mileage with my civic - $5 million
microsoft - xbox live.. duh - $5 million
viagra - only 3 1/2 hours instead of 4 - $5 million
jay z - last cd sucked - $5 million


holy shit, i'm never going to have to work again !!! ... but it's ok, cuz i'm not some 18 year old kid looking to get rich..






fucking tools... i hope to god the judge laughs in their faces and they get stuck with the bill

The entire concept is so very stupid. If anyone can explain how five million dollars worth of damages was caused, or how these jokers deserve the entire sum themselves, I'll be truely suprised. This type of service is prone to downtime, hiccups and other service interuptions - it is the nature of the beast. I'm rather suprised at how well it has been doing overall. Sure, download speeds can be slow - but overall the service is a quality one.

Now, These folks (and those supporting them) want Microsoft to enlist the support of tarot card readers or some other kind of fortune teller service to predict the strain that will be put on the servers over the holiday season. They've already said they reinforced the servers before the holiday season - but they broke into record numbers and the servers faulted. This type of reinforcement takes time, money and engineers to implent into existing systems - yet these folks are suprised when they can't get upgrades implented in the two week period it was down when:

    - Sourcing parts would be difficult during the holiday period.
    - Minimal staff would be operating during this time.
        (And to be frank, If I got a call from the boss on my Christmas morning as I'm opening presents with my         family or while I'm enjoying my well earned vactation I'm going to be pretty hesitant about dropping         what I'm doing and heading right back in to spend days upgrading servers.)

To be honest, If an online service really does have this kind of impact on your life that you demand compensation (of about 20c Australian per day, or  $2.80 for the entire to weeks) you have some serious priority issues which the $80 a year could be better spent on. Sure, the downtime could be annoying - but it is NOT worth the court's time and effort.

If you don't agree, or if you are unhappy with Microsoft's product in any way - you are more then welcome to terminate your subscription.

what happened to that "free xbox live arcade game" they where supposed to give out not long ago?

i assume since this lawsuit took place all that is gone now?

No, I can't and wouldn't... I have bigger things to do, like not being a douche.  


This same thing they are suing over happens every year on River Street in Savannah.  On St. Patrick's Day there are eo many people in such a small area that the tower's can't handle the traffic.  Guess what? Nobody sues.  I'd like these lawyers to find something, somewhere that says that the service guaranteed to be constant. Doubt they'll find anything.


It's like suing the toilet for not being able to handle all your shit. STUPID.


I hope the judge orders 5 years of intermitten time-outs on their internet just to be a dick.

I agree the only thing they should get is a refund for the live service. Why are they collecting 5 million on our behalves. If that is the case I want to be included in the lawsuit. Since they are speaking for me, they can pay me. Why do they have more of a right to the money then the rest of us. If they do follow through with it I'll sue them for speaking on my behalf. 10 million sounds about right don't you think?

i agree here strongly to! wink.gif ... cause thats the only "fair" thing that should happen is refund for the lost xbox live time. maybe a hair more tops! .. but the lawyers dont care as they get to line there pockets with BS lawsuits like these sad.gif

you all should look up what a class action lawsuit is.

These guys make the lawsuit then it is opened up for all Live members to sign into the suit.  If they win you get a cut of the money.  They don't take the 5 million.

10,000,000 Live members means they are only asking for 50 cents per member.

Live costs 13 cents a day so it is easy to see where the 5 million comes from.


that being said the suit is gay and what MSFT has offered us is better than what they are suing for

Probably not. We'll end up getting something for it; but giving something away for free to 10 million people doesn't happen overnight. I would think that we would get 400 MS points each, that seems like a good payback for all the troubles IMO.

And these three guys who are sueing MS... Are they planning on sharing the $5 million with every gold member who had trouble in December?  dry.gif

it is stuff like this that makes me ashamed to be American. sure, they couldn't play halo or call of duty, but there is something called REAL LIFE. they need to get a life....or remove themselves from the gene pool. preferably both.

Class action lawsuite is not 5 million per plantif  but 5 million / Number of Plantifs


Xbox Live  revenue = 10 mil * 50.00 = $500 mil

5 million would refund 8% of XBL members december dues.

I don't think 5 million is high

OK did no one read the posts last time this was news?  Are there really that many who are so eager to voice an opinion they don't bother to look at the details before saying something unfounded?  

Look in the last news post about this, I posted there too but to make it short:

1 ITS CLASS ACTION FOLKS!! These guys are not making $300k each... they are suing on behalf of thousands and maybe millions who suffered during the outtages.

2 No, no one can garauntee 100% service coverage, and in case unexpected issues come up, no it would not be right to sue.  But nothing unexpected happened, MS sold a LOT of consoles (which they knew they would) they got a lot of Live signups (which they knew they would) they didn't increase server ability for the influx of new customers (which they knew was coming).   This is not a case of an accidental outtage, it's a case of negligence on their part.  

I said it in the last post, a doctor wouldn't be liable for a scar that came from burning off a wart.  He would be negligeable if he poured nitrogen on your whole arm and scared you badly.  

3 Yes we each only lost a few dollars over this... MS made how many much money for the weeks (actually live is STILL giving a lot of people problems) during those weeks?  Why should they get the profit for time the service failed due to THEIR negligence?

4 Giving away a game could be looked at as making us as consumers whole but it does little to nothing in terms of encouraging MS to avoid this sort of behavior in the future.  

Again, if you are 30 minutes late getting home for curfew, it would be silly to ground you for 30 minutes... you would get grounded for days/weeks right?

5 To those who say we should ONLY get refunds for our 2 weeks have you done the math?  10 million users at $50 a year is $500 million dollars... thats almost $10 million a week...

In 2 weeks MS makes $20 million in Live subscriptions...

$5 million doesn't even cover refunds for 2 weeks!!! If you argue we deserve refunds, well you are then arguing that MS should pay MORE than $5 million!!!  Now there's irony for you.

People voice opinions in the last news thread on this issue that Americans are stupid sue happy morons... that's uncalled for an uneducated, but it sure doesn't help anything when people jump into criticize a situation they haven't even bothered to try to understand thoroughly...

Better to keep your mouth shut and have people think you an idiot than open your mouth and remove all doubt...

I think it's Chancer who's sig says think before you post... it's pretty obvious a lot of people didn't.

Oh and as for MS being limited in how they can tell us how they are fixing live and how close we are... doesn't that mean live is STILL not fixed?  So much for 2 weeks... and I don't need someone to tell me that they are still working on Live... how about this, how about they way they tell us Live works is... WE CAN LOG ON AND USE LIVE RELIABLY?  That's all they have to say!

i hate when i see crap like this (no offense) cause just because someone plays videos games instead of doing 'other stuff' does not mean they have no life.... some people prefer playing games over other crap you would call "having a life".

It's really pathetic and uneducated to marginalize what someone else finds valuable and what someone else enjoys doing... It shows a very weak argument to resort to personal attacks rather than state logical points.
