Does You Get Banned From Live For Having A Modded Xbox360 Or Backup Ga

I was wondering if you got banned regardless of weather you are using a original game as opposed to a backup when on live or if you simply get banned for having your xbox 360 modded ?? Or is it a combination of both?

Check out the hundreds of threads on this in DVd firmware and general.
Too many of these appearing in here and the question has been answered a huge amount of times.
