Using Live On Modded Machine

About to take delivery of a mooded machine & have a couple of questions....

Reading these forums, I am safe to assume is currently NOT a good idea to play ANY game on Live at present ?  Best wait for a firmware update before I proceed ?

Will I still be able to access ARCADE & download stuff (ie Sensible Soccer) without fear of a ban.

If I were you, I wouldn't get on XBL with any type of modded FW to do anything!!
