you could try using the HDD of a working console that has been updated and accept the prompts wen it boots up, however, I have been told by xbox that if u do this the hdd will ban the unmodded console. how true this is?? dunno, never tried it.

This is not true; nobody seems to have been banned for using the HDD of a banned console on an unbanned console, and MS themselves claim this is a valid thing to do.

If you plug the HDD from an upgraded console it will indeed prompt you to update and this is perfectly safe as far as anyone knows. Various torrent sites have the dash update available for download to burn to a DVD also.

You'll get the new dash features, but you won't get DivX support as this is not part of the dash update itself. DivX support is a seperate download that is automatically retrieved from Live the first time you attempt to play a DivX file, and the download is locked to the console that downloaded it. At present there is no way to get DivX support on a banned console.
