if this family cant afford 50$ and overdrafted their account because of it, they are just looking for money. Come on people how hard is it to keep a positive balance. If you cant afford 50$ to be pulled from your account you've got more issues then suing MS. It also states very clearly that these charges are automatically recharged every year

i used a prepaid cc for my account and now just use 12 month cards to keep the account payed up. the cc ha long sence expired m$ doesent care. however if you read yea you knoe reading other then blindly hitting accept. it says 2 majer things and why the case is useless. 1 you have to be 18 or older to accept the agreement. and 2 the account is a reaccering charge montly every 3 months or every year depending on the account you make if you do not wish this you have to call and cancle the account befor the charge or use a prepaid card.

m$ didnt have to give him anything back and they where nice enough to refund the charge.

actually, this is one or should I say, yet another area where MS needs to smarten up as well

I was paying 3 months at a time at first and got dinged. not a big deal, but the principle of it bothered me. And when it came for my account to expire again, I called ahead of time and said, please cancel my account when I'm on my last day so I do  NOT get billed again. This was 2 weeks prior to the end date.....the @#$@$# er cancled my account within the hour of the phone call and of course I never got any money for the 2 weeks I lost.

So, I don't get live anymore, not worth my time and money or the aggrevation.

Ok this whole lawsuit is a bunch of horseshit.

As for the automatic renewal for XBOX LIVE, I myself got an email from Microsoft informing me that my subscription was about to expire and that they were going to use my credit card (the one I used to sign up with) to renew my subscription. Yes, I received fair warning that my account was going to expire.

I called Microsoft and told them I wanted to use a pre-paid card instead of my credit card from now on. They removed my credit card information and downgraded my account to a Silver. I went home that night and used a pre-paid card to upgrade back to Gold. Worked flawlessly.

Here's another case of an irresponsible parent trying to abuse the legal system instead of beating his kid for using his stupid debit card without permission. If he can afford a class action lawsuit, he can afford to have $50 in his bank account!

How about the dumbasses of america stop using bank of america!!
If you're getting charged for overdraft it's your own fault. Get a respectable bank.
Like a couple have people mentioned, if you can't afford $50 for xbox live, pawn your xbox. Feed the rugrats!

BTW an injunction is free. He was probably betting on M$ to pay up then to pay an attorney to stand in court. Injunctions can come in handy. Most corporations will hand out $50 rather then deal with litigation.

1) Dad should have told his kid "no."
2) Dad should have read the terms and conditions if he said "yes."
3) Child should not have lied to MS about being 18 or over.
4) Dad should be more financially secure so his account doesn't get overdrafted.
5) Dad should have repremanded his child after he gets billed for an autorenewal and overdraft fees.
6) Dad should use this experience to help get better at controlling his finances.
7) Dad should become so depressed that he starts drinking heavily.
8) Dad should buy a gun.
9) In a drunken & depressed rage, Dad should pick up his gun, murder his son then shoot himself in the head.
10) Two less idiots on this planet are still alive.

I think it's BS that M$ doesn't allow you to confirm auto renewal.  They just do it!  I remember when the xbox had an auto renewal option.  I guess M$ figured it out... People forget when their subscription anniversary ends and BAMMM, get hit again for the fee.  Most people don't even know it... or may not be using live anymore.

Many people, including myself, have a separate bank account for "bills". I only deposit enough $ into the "bills" account to cover the actual bills. The rest of the $ is in various savings/money market/etc accounts. I also have a "personal" account that has the funds for general household use. This way I NEVER can spend too much on personal goods and cause a bill to not go through, etc.

Why do this? Because I like to do my bills once a month and not look at the account every day. I don't maintain a checkbook, etc. I have fraud prevention turned on my accounts as well, since I don't look at them often...

That being said, if an unauthorized bill went through my bills account, my account would overdraft too! I mean, I keep like $20 extra bucks in there just incase, but $50 would certainly overdraft my account. That doesn't make me too poor to be on live!

Another thing, who's to say these people keep all their money in the bank in the first place? I know lot's of people who only have money in the bank for their bills, and all the rest they withdraw...

As to the lawsuit, LAME. You agree to the auto-renew by not cancelling it or informing them that you do not wish to renew. Lot's of subscriptions work this way! It's their own damn fault they got charged. The dad should be upset with his son, not MS$!

Umm, yeah.  You were doing fine up until point 7.   I agree this whole thing is a bunch of crap as auto renewing subscriptions are not uncommon in many industries these days.   However, if everyone shot themselves when they did something stupid in their life, I guess only animals would be left to rule the planet and this whole issue would become moot.

all you had to ask was for them to disable auto renew.  They would of disabled the account from auto renewing when it expired.

they shouldn't have auto renew without a pop up saying they subscription is over and if they would like to renew it and or not..if not then cancel it and let them enjoy silver till they get enough $ to get gold

Xbox has been charging me for 2 years.
My son used the account.
We did not know they would be charging monthly.
How can I join in the Xbox Live class action suit?
Does anyone know where there is class action
suit going on now?
