I'll be getting around to that soon, don't worry. In about in hour, I'm going to file a dispute through paypal if he hasn't sent my refund back. Below are a few of the messages we've sent back and forth:

Him:
if you send it back i will refund ur money

I'll have it packaged up and ready to go tomorrow, but you are refunding my money first. If you'd like to stay in contact with me thoughout this transaction then below is some of my contact information. I'd really like the refund ASAP so that I can go ahead and buy another console to play. Thanks

That's fine, I can just open up a dispute with paypal myself. You obviously knew the console was banned from XBL which means you basically lied to me. How can I trust that you will even give me a refund once I send it back? If i'm not going to receive a refund willingly, that is fine, but I'll bring ebay and paypal into this and we can settle it legally. I've spent over $300 on this console and all of its accessories, I'm not going to let it go.

Now, we can settle this very easily. You refund me the amount I paid and I ship the item back to you. I've given you my home and cell number, so you can get in contact with me. If I don't have the refund in the next couple of hours, I'm going to open up a dispute in paypal.



I haven't received a reply yet, but If I don't in the next 45 minutes or so then I'm opening disputes with ebay and paypal. The guys ebay username is baseballplayer1j

When this all gets worked out, I wouldn't be surprised if he reposted it and tried to cheat someone again.

You might want to file that PayPal dispute sooner than later because all he has to do is withdraw all the money in his PayPal account and then you won't receive anything from the dispute, I learned that the hard way.

Actually you will still get your refund, even if he doesn't have money in his account.  It will put his account into negative status.  

Happened to me before in a dispute that was wrongly decided in the buyers favor (said he never received Oblivion from me, 2 MONTHS later, despite USPS saying it was delivered!).  Anyway, as the seller, I didnt have money in my account, but they still took it.  They put my account in -$55 status.  Eventually it was corrected though, as Paypal investigated further, and I eventually got the $55 back.

Paypal will tell you you have to return the item to get a refund.   It's different a buyer saying the never received an item versus them wanting a refund on something they acknowledged receiving.  I've been through it already as seller, but it wasn't for anything fraudulent like selling a banned 360.  The buyer decided he didn't want to return it and that was the end of it.

Wow after only about 30 minutes after I submitted the claim, I was refunded. hah. Much easier than I expected. Problem solved I guess? lets hope.

this would have been enuff for me to think maybe it might be banned!
most people that mod the 360 case get the ideas from sites like this one so theres a good chance of it being modded aswell.

and not every person that sells a banned box on ebay is a scammer some just dont use live or know they have a banned 360

i do agree and understand how much this can piss u off off ive losts 100s from ebay and my advice is if he will refund after the return then do that send it back recorded thou







did u get it all back with post and package

It's all good, I'm refunded and already have another 360 on the way, and this one is still under warranty  biggrin.gif

One thing though...he knew it was banned from XBL, he just failed to mention it.
