have you tried calling MS and asking how to change your region?

Also I've never heard of anyone getting banned for having an account in the wrong region, Blocked from certain content in the marketplace, yes, banned, no.

People MOVE all the time, it's not like Ms would just up and start banning those people.

isn't the 1800-4MY-XBOX or whatever number free anyway? and good luck in sueing them when you are the one that broke the TOS in the first place. the information you give them has to be %100 correct

and yes, people have been banned from specifying a different region that they live in
