A friend of mine did not download the H3 Demo, he didn't even played the Crackdown backup game and turned on the console a few minutes ago and got banned (He's got modded x360), and another friend have played the crackdown backup some days ago w/o downloading the demo and still on xbl.

1. ¿So are the bans randomly?
2. If you have not been banned and you downgrade to original firmware, will you get banned anywayz? since ive read some ppl did that and still got banned (rumors?); ¿Is there a Log from xbl since time ago to know who is using backups?.

i think the most important detail is your console mfg date and whether the drive was spoofed

* console from february 2006 - flashed firmware since may 2006

* have had numerous flashed drives and none were ever spoofed

* played at least 1 backup in april(before nba playoffs), but that was offline; last time i played a backup on live was in march 2007

* have mostly stayed away from live for about 3-4 weeks(since nba playoffs), but when i have played online it was with original gamedisc

* restored original firmware and downloaded all updates yesterday; played h3 today

* not banned

from the comments in this thread, it seems to me that the consoles that did not require a drive spoof(pre-may 2006) are possibly not affected by this banhammer. however, i am also not going to reflash my console until somebody a lot smarter than me says something to this effect.



in the meantime, if anybody with a ban that see a similar pattern in their console usage, please let me know here or via pm.

I have not been banned yet, I have a  modded hitachi 46 or 47 - can't remember.

I unplugged a week before the update, plugged it in to update and immediately unplugged again (just wanted to the new codecs for streaming). Figured I would sit back and wait for the banhammer of wrath to hit you all  tongue.gif

Now I'm wondering if there's a new firmware for my drive or if I should flash back to the original.

I had fun with the backups but I have bought all the games that I really like - 'cept for Vegas but I can always buy it.

What we should really do though is make a sheet with country/firmware/game to get a really clear picture of what is going on. Right now its a flood of posts about being banned and there is no clear line.

I have a samsung with 5.2 firmware, I haven't played any backups since the last update and I turned on my 360 to see the bad news and I wasn't banned. Do you think it was just the people who played backups after the last update or what?
