It would be VERY unwish to produce XBOX games, each with unique numbers or serials for checking, they are all copied from a master disc, changing this everytime would be costly

Theres a logical "rolling ban" theory, Microsoft are moving down the list of flagged consoles, banning one by one, making it seemingly random as noone knows the order

It only annoys me the people with original online are being banned, not fair, but using flashed drives breaks the xbox live contract signed when joined thus you are stuck

IMO, with the new jitter patch, they can't distinguish originals from pirated copies.
That is why they do not stop games from running. You paid from a console, so they are not allowed to stop you from playing originals, even if your drive is modded. And given that they can't say for sure if a game is original or not, they can't stop the game from booting. With live, they can because it clearly state on their agreement that modded consoles will be banned. Also, technically it is easier to do so. I guess they started banning by comparing the game IDs that are surelly sent to MS, when on live. For example, your gamercard has all the games you played, with archievements.
So, probably the people that are banned played games downloaded scene releases, that had their serial number/game id blacklisted. People that run their home made backups are not banned, because of them not being blacklisted. They compared the serial/game ID with the scene release, and dang: BAN!

I couldnt' flash my sammy drive cos i have no sata, so i chipped the dvd drive. since the update i only played originals and i was fine, no bans. Yesterday i removed the modchip to be safe then played some gears of war. This morning i try playing, and im banned.

I see some of you are trying to put the finger on flash before it ever seeing live. Well the thing is each Xbox has its own ID and im willing to bet that ID is no different than the Window GENUINE deal. If this is the case then when the Xbox was made that ID/serial has everything about that system, model of drive/firmware serial, HDD version/serial (though this can be change by buying a new MS HDD), and so on. When that box is finally connected to live MS can and could verify that that system is in the same state that it was when it was scanned at the manufacturer.

I also saw stated that the game disc could have unique IDs now (or have had) and that it would be impossible to ban anyone being they can rent the games from Gamefly, Blockbuster, ect.. You also have to remember that places like GameStop, EB, and even EBay sell used games. There also is the case where say your buddy hates   a game and gives it away. so that would be very bad if they banned people if the game has been used on multi systems.

Though when a game is released to the scene that game is being used on live by multiple people so in that case if MS does see that Gears Of War with the unique ID of 1234567890 is being played online by 50,000 people at the same time... then im sure that would be a no brainer for MS to ban anyone using it. MS can and could be downloading all these scene releases and flagging those ID's (if they are unique in each game) just like how they flagged the XP keys in the SP1/2 updates.

I'm actually glad to see MS is doing something about piracy. Piracy can kill game developers and or just make them not care about putting content out cause everyone is not buying them. I have yet to buy a game that has become a dust collector thanks to XBL now having demos for most of the games. And yea legit backups I can see the point, having a nephew that broke my PGR3 disc, I wished I would have had a backup.. but thanks to MS's replacement program I got a new disc. If only they could get ALL the games on this program there would be no need for legit backups. If only they could work out a deal with say GameStop/EB so that you could just walk in a get a replacement... hint.. hint..


Make sure you tell your friends that if they are thinking about getting a 360 on EBay to maybe think twice. I'm sure there will be a lot of systems that will be sold that are banned..

There are MANY eeprom theories, a popular one is another marriage theory (hello vetern xbox 1 modders) which would be "typical" of Microsoft, but doesn't explain some peoples being able to flash post update and be ok, but there are two things i'm waiting for

1 - An annoucement from someone who knows whats going on, no offence to us, but 90%+ of us (including me) have little to know idea whats going on.  Most people are looking for patterns with popular details such as flashed drive model, live playing, flashed firmware etc, when it could easily be FAR deeper

2 - Time, its going to take it and Microsoft has the upper hand, always will do

2 - to all those parents out there, no, your small child should not have access to anything that they have the potential to destroy. if you don't think they can care for it, teach them to care for it. if you don't think you can teach them to care for it, either keep it from them until they can or don't have kids. your choice. when you go out to buy a couch, and you bring it home, you can't 'back up' your couch, can you? what do you do then? allow your kids to destroy it? no, of course not.

+1 After reading all of this, I can only laugh at most of the post on here.  man, I didn't think people would be sooo mad about being banned when we had to experience this with the first xbox.

Some guy in another thread suggested to disconnect the 360 DVD sata cable and connect to live, to safely see if you were indeed banned.

Anyone tried this, who doesn't know if they're banned?

OMG! i can't read anymore!!! i'm gonna leave it up to the Pro's i've been reading like non stop for the past few days following every post tryin to see what i could make of it... i'll be playing offline till i see something on the Xboxscene.com main page, or at least the pinned topic on it updated. all you guys in here are doing a good job tryin to make something outta all this madness, keep up the good work.

also i would like the thank www.xboxscene.com and all its admins for keeping us all up to date so quickly after shit hit the fan.

Once your 360's serial is banned it doesn't matter what you do.

The dvd disconnect is for people who think they are NOT banned but wanted to check safely anyway, run connection test!

As soon i heard about Disc-Jittering etc. I removed the ethernet calbe out of my 360. So i have not yet installed the Spring update. I`m gonna wait till i know how MS find the modded consoles.


Another Theory:

Microsoft released a modified backup of a game and put it on many torrent-sites. When this game goes online, Microsoft did notice it and have flagged your console. (remember the fake Half Life 2 backups)

Only noticed the posts this morning in relation to the bannings, but did not use Live since before the Srping update. I have 5.2 of the firmware. I powered on the 360 today and went to sign in to LIVE without any games in the xbox. I got a failure signing into Live, and when I went to test the connection I got a pass for all of the tests, other than xbox live. There was no screen saying I was banned, and a blank dialog box. There was an option for the status codes alright.

It's no confirmation that I have been banned, although the fact that I cannot sign into Live is bad. I never did the Spring Update, downloaded Halo3 beta, or successfully played Crackdown online.

Any thoughts? Is it just Live is down now?

 Cant believe whats happening....! my console has yet to be banned. Is there a way i can find out without actually banning it? My best guess is that Ms has been making a list of all games you have played backup and original and then just gathered all the info and banned everyone
   Or monitering your firmware since fall/spring update to see any changes
