It's not that simple man, there's issues of technical support and returns to be considered. What happens when Joe Blow installs a theme he downloaded from www.pornandviruses.com and all of a sudden his Ipod/360/ is bricked, or his Windows installation gets messed up? Then he calls up Apple and/or MS and starts whining to them, demanding a replacement and getting upset when they deny him or they want him to pay a fee, when other people with more important issues (Like you bought a 360, didn't mod it in anyway, and it messed up) are being put on hold while Joe Blow argues with Microsoft's CS about why installing the BrickMy360 theme shouldn't void his warranty and blah blah blah. It sounds dumb, but there are (unfortunately) some people that don't know any better.
And then, Joe Blow, after getting denied by Microsoft says, well you know what, I'll go buy a new one and swap them out. Then some other unfortunate person is left with Joe Blow's bricked 360, when he paid for a new unit. Then he has to go back and make a return and so on and so on.
And then apart from that, MS and Apple would have to spend more time, money, and resources into developing other UI themes. Not saying it shouldn't happen or anything like that, but it may not be that company's priority to make the best looking dashboard when the current one works fine.
Can you name any other [good] MP3 player that lets you change the UI? One that is comparable to the iPod?

First of all, we're in the 21st century, charging for downloadable content is a highly profitable business no matter what market you're looking at. I don't see why MS shouldn't charge for themes, it's not like you HAVE to buy them, no one's forcing you.
As far getting "unlocked hardware" that runs homebrew, neva gonna happen. And it doesn't matter if the company makes profit on the hardware or not, still not going to happen. Nintendo always makes profit on their consoles and you don't see them spreading their legs for all the hackers and pirates to come play. For starters, not everyone cares about homebew. More importantly, not everyone is smart enough to figure out how to get homebrew stuff going. And most importantly, homebrew would increase the chances of piracy and viruses developing (with the viruses statement leading back to the part about technical support and returns/replacements). Just not going to happen IMO. I'd like to be proven wrong, but I don't see it happening.

Well sure parents can regulate it, but having adult content would give MS the wrong public image. Parents would start seeing the 360 as the "console with the porno on the menu" and avoid it all together, regardless of whether it could be blocked or not. It's just not a smart move to have adult content on a machine that you want everyone to buy. It's not like a lotta people are going to not buy it because it doesn't have adult content.
