October 17 Downtime for Xbox.com and Xbox Live

From xbox.com:
Quote

We've got some scheduled maintenance coming up and want to let everyone know that both the Xbox Live service and Xbox.com will be offline and unavailable starting at midnight Pacific Time on Tuesday October 17, 2006 for up to 24 hours. We know you've got some questions, so here are some answers:

* Q: Why? Why? Why?
* A: Because we're adding some cool stuff. And we have to take the service and website offline in order to do it. We're not doing it to make you mad ... really.

* Q: What kind of cool stuff?
* A: Secret cool stuff that we'll tell you about when we're back online October 18. Other stuff we'll be talking about later in the fall.

* Q: Is this a Dashboard update?
* A: Nope.

definetly not firmware related:

"Because we're adding some cool stuff"

banning hacked firmwares would be "not so cool".

It wouldn't suprise me if MS adds something to detect firmware hacks.  I'm just glad that I haven't flashed mine yet, I don't want to turn on my 360 on the 18th and have a message saying "you have been banned by the MS haxxor police."

Is XBL going to credit our account for the lost day of access? Fair is fair, right?

Also, why can XBL send down firmware w/o asking us to accept the EULA? I have to accept THEIR terms to patch THEIR buggy version Windows...

huge game release window coming up now would be the perfect time to nip the firmware problem in the bud, or at least slow it down so games sell to curb the thieving pirates schemes.  Comes the day UBIsofts heavy hitting splinter cell ships to stores

Shit. What options will firmware hacked drive users have regards playing new games. On or off line.
If the banning due to firmware means we wont be able to play new games because they require the dash update, MS will be effectively making every modded xbox worthless.
I bought a modded one and cant refresh because I only have a Mac.
What to do?

@MeanMF looks like your gamerpic wants to volunteer

@laurie the question is even if you re-flash to original will it be detected as such

They're probably bundling a bunch of cool stuff along with the firmware detection. Since they can't force you to update, they just make it really appealing to persuade you to update.
