just wandering if it is ok to update the 360's live using the old xbox games, as it says i need to to play them on live on the 360. any help is great thanks

Well it's simply not possible. Once you connect your 360 to live it'll update itself automatically. Using original xbox discs to try to upgrade live would attempt to copy the xbox live dash from the original xbox. Since the 360 can't natively run xbox code it would have to run dashupdate.xbe from the emulator which I highly doubt they provided support for. Needless to say even if it somehow ran(which it won't) it would not effect your 360 at all other than if the device/partition it tries to copy the files to actually exists it will take up space.

why it says you need to play them on live on the 360 is so the 360 can download the emulator profile for the game you're trying to play.

well it was strange, as i tested it on halo 2 and the rainbow six games. when i start them up on the 360 and select the xbox live option, it says the xbox live service must be updated, it then loads up the old xbox dash, obviously like you said from the disc, and shows a progress bar. when finished the game reboots and still loads normally, it seems this has had no effect on my 360 but i just thought it was strange, and i thought that this little glitch of the 360 launching the old dash could lead to some kind of hack or software exploit
