I was kinda curious about this too.  Honestly, as long as you don't try to log onto Live with your modded/banned Xbox1 after you setup your Gold account on the 360, you should be fine.  I can't imagine people buying a year subscription and suddenly being banned AGAIN after logging on with a new 360.

they are talking about people whose ACCOUNT has been banned. which happened only in a few rare cases, such as cheaters and people who fucked with the cache data for live.
otherwise banned users wouldn't be able to go on live with a new eeprom/new xbox and their old account either.
