I was banned around the time halo came out. I believe it was the first roll of bans microsoft ever did on people playing backups on live.. so I always heard, "if your banned, your banned forever. End of story. You'll need to buy a new xbox." Well obviously thats not correct. I was banned for a while, but not forever. So since I have a new account on live and if I play legitimate original copies of games on live, will I get banned again because of my modified firmware? Sorry if this is a stupid question, I've been out of the scene for a while.

Microsoft had a lot of issues in the first (and maybe 2nd or 3rd) 360 ban waves of banning legit users. So they ended up unbanning everyone.

That depends on how they set up the conditional probability algorithms.  Only they know. So, you play a dicey game when you mod your console. Some people get banned while others don't. They are trying to get at least 70-95% percent ban rate. So that 25-30% usually slip by. It's unexact.  Just get a console for your backups and one for your regular games.
