I think you are Absolutely correct.
I have a pretty hefty surround sound setup and I usually play my games with it cranked. When I went to test my drive sound I shut off the receiver and popped in the nearest disc (DOA4)... I just recently got COD2 and a day or two ago I went to play it and happened to pop the disc in before powering up my surround sound, the drive was MUCH MUCH louder then before, trying different games the noise level was different, PGR3 and COD2 are the worst offenders; running the drive at full blast ALL THE TIME. While games like DOA4 (and one or two others I can't remember) only run it fast while loading and return to quiet speeds once the game is loaded.
When my PC DVD drive runs at 48x it's loud as heck too.
So really the loud drive problem is based in the programing, rather then adjusting the drive speed as necessary they just run it at full blast all the time.
