The DVD does't check the media, the x360 does a per executable signature check and decryption. So it doesn't matter what media or transport mechanism is used as no load sources of executables is trusted except for main memory. (likely)

perhaps through the emulation of xbox games, we'll find an exploit... and how the hell are we supposed to transfer saved games from xbox to xbox360? Do the memory card slots fit the old cards?

no i dont believe so, maybe the x360 can detect xboxs on a network or maybe you cant transfer saved games

Unfortunatley, MS said that content is non-transferrable.  Well, that's the way it was last time I checked.
