Kinect Games / Ap 2.5

I am assuming these are not AP 2.5 games so if I make backup of them (Kinectimals, Dance Central) using a Lite On drive with 0800 firmware I shouldn't have to patch.

Am I right to assume if I backup Need for speed, Fable, and Assassins creed that I will have to patch them.  I was under the assumption that the current 0800 drives cannot pick up AP2.5 information
