Halo 3 Backup And Oteher Questions

ok so i was wondering if i buy a new xbox 360 from like costco and it has the HDMI port, how can i flash it(im pretty sure that it is going to be a BENQ drive) will i be able to replace the drive with a samsung without havent any ddifficulties? and i was wondering if i have the ORIGINAL copy of halo 3 and play that online will i get banned( because i have a flashed xbox 360) or does it only get banned if u have a backup and play THAT online? the reason i am asking these questions is because my friends play online but i dont want to spend the money on games that i will not play online so i will jsut buy backups and play the campaign? sorry if this is a little tooo comfusing. but i will try to straighten it out as people post and ask questions.
