individual state - they know where you live; and this is a US not an EU problem.
age - there are many other past times that require you to be 18, with dubious 'proof'. Including internet poker
tax - not really fussed about the US; gamblings tax free over here

In anycase you can't cash in your credits, therefore its not an income and not subject to tax.
It would be easy to have (as various poker programs do) two versions of the game that can be started from the same lobby; one for gambling after verifying who you are, and one for those living in a nanny state where you aren't allowed to have fun: hence also solving the problem of running out of credits.
None of your points are a real barrier to credit gambling, although yes it would require legal work. heaven forbid MS actually gets some lawyers

- especially when they would have created a HUGE advantage over Sony Live (or whatever they plan on 'inventing'). PROPER gambling on your sofa, not a half baked version that will make me move to my pc for a game.
