Disable the console/Flag the gamertag.

I suppose your right in saying people aren't banned just for having a modded xbox.

Having your gamercard flagged is akin to buying a chemestry set and having your name put on a government list of potential terrorists. Yeah it means you're under closer scrutiny but you don't actually get in trouble for it.

In all honesty I'd be supprised if my name WASNT on a list somewhere at MS.
