Use this guide to find out when your 360 was actually manufactured. If it was February 09, then the last 5 numbers should be something like 905XX, 906XX, 907XX, 908XX, or maybe 909XX. If it's anything around say, 924XX or higher, then it was actually manufactured in June or later.

Thanks yes I had also checked that earlier and it is indeed 90907 but heres the kicke... fkin BING sticker on the package box! A quick wiki visit reminds me that BING was released Jun 09 so I guess like antisniperspy must be an MS repackage job so I'm BINGd 3 bills now lol but thats the risk. Maybe if I contact some of the FAQ makers they might add watch out for a BING label on the "iffy" kernels info.
