well it was around to be flashed from 1.5 to 1.6
and he mentioned it was playing as a dvd over half of the time

i flashed it to 1.6 and cleaned the laser with isopropanol while it was apart

its still doing it

i flashed it from new for him in jan 2009
and he said it has done it since new

He may have a defective laser or the media he is attempting to ready is bad (dirty, bad burn or such).  I would replace the drive or laser and see if the problem persists.  Good luck on this one.

I would swap drives to narrow down the problem between drive and media.

not likely...   did you modify the games in anyway before burning?       like wave 3 disabler or anything?
you could try ix 1.5.1  which has better tollerance then 1.6
