I phoned up MS C/support and they said that if the console had been banned that was it, I reitterrated to the guy that it was the account that was banned and it was on the same day that accounts xbox live membership ran out. He tried looking into the matter but couldnt find anything on his system he then told me query number and that I should wait for MS to e-mail me about the querey. I have yet to hear anything via e-mail from MS.
Personnally from the way things are looking MS have totally fucked up the banning process on this ban wave somehow. So we could just get lucky you never know.
Yeah I have two consoles, my modded console got banned the week after the Fall Update and always said "This Account has been banned". So I tried to login to my account on my unmodded xbox and sure enough, I can connect.
However, Just after the recent ban wave last weekend, my unmodded console was banned too. I wonder if they're following my account and banning every xbox I use? Or did my 2nd xbox just get caught in the mix with the other innocent consoles?
Either way I'm very pissed. I see the reason for banning the modded console, as I did violate the Terms of Service. However, it's absolutely ridiculous that my other console that I bought JUST TO USE LIVE got banned when I used it for nothing other than playing my 3 original copy games I own on xbox live.
EDIT: Also, I believe if your account is banned, you can just create another silver one to verify it. If not, well then your console is. You could also try taking out the hard drive and doing a network connection test (at least I think? I don't know, this really isn't my area of expertees) to see if it still says "This Account Has Been Banned". It might just be referring to your xbox360's serial number as an "account".
