2 friends of mine have both hitachi drives and use an old Extreme FW (dont know which ones - march this year). They BOTH played online with BAD kreon rips (halo3 e.g. - checked both with mulleter and kreonchecker) this year. And both still are NOT banned. This imho is a fact against the theory of MS making Logs, because otherwise they both should have been banned by now - if this was a new Banhammer.

Think of this, if they are playing bad rips on xtreme firmware there is pretty much no way MS doesn't know it... I mean that's a double whammy... so why aren't they banned yet? MS has had plenty of time to find out about them so it's not like they are just waiting to be found out...
It would seem that MS must know about them but just hasn't done anything yet...
Now that leaves two options... MS just doesn't care about them and decided screw it, let them mod and get away with it - or they are on some list that hasn't been effected yet for whatever reason.
Just because they aren't hit in this wave of the ban hammer doesn't mean they aren't on a list... maybe MS allows some people to evade multiple ban hammers (in fact I think some people have reported evading multiple bans already) for a few waves... if their intent is to make it hard to figure out what's going on, then letting a few people go 2 or 3 waves even would only stand to make it more confusing for those out there trying to read a pattern into it...
Not saying this in any way proves a list, but it certainly doesn't disprove it either.
