It also seems that everyone that has a new console that flashed after update isn't banned. Maybe this update was to check if the CRC would pass with the original firmware and after the update there is no more checks. even if this was the case, they could query the crc of the firmware whenever they wanted - hell they could have it installed somewhere in the machines eeprom for all we know - the code to do this would be very small, especially in asm.  anytime your box connects online it could be queried so you would never know when it will happen.

personally i think they are doing it random anyway just we don't figure out how what they are querying.  i am sure in a couple week we may see a pattern, but right now i highly doubt any pattern will be seen, and even if there is, it could probably be changed anytime.

i will add that as of right now, my 360 is not banned, but i have not played a game online since the spring update.

for me, setup is ms28 5.2c flashed a couple months ago, spring update done with the 5.2c f/w on the machine but again, i have not played any game online (not a big 360 online gamers) since the update, only offline.  so who knows...

My personal console had NME1.1 (hit 47dj) from ~Oct 06 to early May 07. Constantly on live with and without backups. Until it died. Swapped consoles with a friend.

From ~Nov 06 - Early May 07 it had an NME1.1 with NO live access. Updates applied via Games. From early may til now it had C4EVA 2.3. Never applied Spring Update. Flashed 2.4 day or so after it was released. Was not on live from May 8th, until tonight. Barely played it other than HDDVDs. Decided to bite the bullet and Test Connection... banned. No spring update.

Well my buddy flashed my box about 3mnths ago. I have done every update and I just logged on to Live. So far, I'm afraid to put a backup in my 360 and heres why...
I work at gamestop and have some hack buddies wgo went out and bought used 360's and flashed them for
the ban test. Everything was all well and they put in a backup copy and they each had different games.
It said there was an update for the game, they updated and POOF!!!! java script:emoticon('', 'smid_17')

playin live, doggin Microsoft. Think outside the box gamers. We had the Original Xbox modded and MS was
pissed. Then they took our MODDED box and turned it into the 360. They aren't very smart. They are all haters.
Also another theory. Bungie was pretty pissed we were playing Halo2 2mnth before it came out. So you know MS tracked all those backup downloads of the beta. If I get banned cool. I want the black360 anyways. And let us not forget my fellow Gamers. "Tunnel Programs" We can all meet up on Xbconnect or Xlink Kai right. If all banned Gamers who payed $400 raised hell... They would have to turn Xbox360 to Xbox180.
They just gave modders and hackers and Xtra credit assignment. I can be done. Well till I get banned. Talk at cha later.

It does have to do with firmware, think about it you have a NME 1.2 firmware chip installed then what the chip does is allow you to be able to use the firmware from the chip instead of the on board ones from the drive. basically same concept. You added chip then did spring update then played crackdown beta right? if this is the case it still goes in same area as before a chip is the same as flashing your original firmware may not have been flashed but in xbox live's eyes they cant tell your running from a chip and thats the firmware there reading. I have yet to be banned as of right now again this is almost hours later than my earlier post. Ive been getting in on as much halo as possible. but have been playing others as well.

Is it me or are there very few 78fk drives being banned?, I personally cant add any data as I am scared to go on XBL, although I have a f78fk drive flashed on the 4th of April but has NEVER played a copied game before I am not sure whether to go back to my original FW or stick with this, there are so many theories ill prob just wait it out for a month
