However, I did think that someone confirmed you could use the MS28 fw flashing method to reflash it if necessary, but I cannot recall who said it.

What if MS does start banning users based on detecting a 4.x firmware? (Despite all this great work, it may still be possible if something was overlooked, hence the need for 4.1 since something was overlooked in 4.0). At least a user would have the option to go back to a stock firmware and use the box as normal and not be banned from Live (if they already didn't get flagged).
Another reason may be that future games might be shipped to not operate if a hacked firmware is detected. Which means you are now stuck with a hacked firmware and can't play any new production discs because you can't flash back to stock.
However, I see your point. The above two scenarios are just possibilities and far from reality at this point. I just read all these other people having issues with the 0800 disc to enable flashing. Granted, if the method were to boot with tray open, there would probably still be issues as a lot of this is probably user error.
Just call me devils advocate.
