Its called market share. MS would probably pay twice what they loose per unit in order to tell the game manufacturers that they have more xbox360's in peoples homes then sony has ps2's. It would increase consumer confidence and sponser confidence alike.

Legally they could not out and out kill your box, but I bet they could find a grey area that would cause the user a lot of problems. Considder save game nukes, they are part of your live profile. Live is so ingrained in the 360, if it was banned, I wonder what else wouldn't work. I imagine you wouldn't be able to even log local profile in.
