Hardmod Vs Softmod

In light of the recent wave of xbox live bans, would it be better to go with a chip instead of a firmware flash? Or does it not matter either way?

I currently have a Globe 360V2 but havent installed it yet and was considering the NME 2. Any suggestions would be appreciated.
