Nme 1.2 360 Cannot Be Banned ?

I would like to confirm that if I play my original Xbox 360 Games with a NME 1.2 Modchip installed, I cannot get banned from Live since the chip shuts itself off for original games? Also, I already have the Samsung 162D with Kreon 1.8,Plextor PX716A DL Burner and Verbatim DVD+DL - so is that setup good for making NME backups of my original games that I own?

I was gonna do the firmware hack but then I heard that they started banning everyone with the firmware hack even if they were playing their original games!

You will still get banned.  Microsoft is now logging offline play, which means that whenever you play a backup, even though you are not signed into Xbox LIVE, Microsoft will still catch you.  The latest updates are making consoles save certain files of some sort to your memory unit whenever you play a backup, and when you sign into LIVE it uploads them to Microsoft letting them know that you played a backup offline, thus banning you eventually.
