you don't have a hard drive that is flashed, your dvd drive's firmware is flashed.

if you already run the latest kinect dashboard - as you do - no update is needed. if it does ask you to update/install something, it is only kinect related. that is no problem and just say yes

do you need a hdd? if you say so, i don't know so i believe you right away. swapping over isn't a problem, since nothing dashboard related is installed to your hdd. that is the reason why it seems strange that you need a hdd for kinect, anything that must be installed should be small enough for your memory unit. so just try that first (memory card=memory unit).

swithing a hdd between a modded and unmodded xbox does not do any harm for your unmodded xbox, but keep in mind that your profile might be corrupted by your banned and modded xbox. so i would suggest to keep a backup of your profile and gamesaves.
