It is suggested you flash back to stock when you update your dashboard. Personally I didn't do this and it worked just fine and no ban.

Also if you buy a new console you will not be getting a BanQ. They have not used those drives in about 2 years now. All is now Liteons.

You never really know with M$ although its probably worth noting that Team Jungle says to flash your drive AFTER updating suggesting its probably safer that way.  Microsoft typically finds a flaw in the firmware and bans people several months after its implementation (usually around November) but you never really know when their flagging to ban.

Got a question related to banning. What happens exactly when you're flagged for banning? Is it the keyvault that's flagged or what because I'm wondering what would happen if you took a keyvault from a flagged but unbanned Xbox #1 and inserted into a banned Xbox #2 to get it unbanned, would #2 be flagged also or no?

You can do that IF you console can be jtaged. BUT you will need to make sure your console has never been on Live since last summers dashboard update and have never played any games that has come out over the past 7 months or so.

Doing that will get you back on Live for about 15 minutes or so until you get banned again.
