Hdd And Banned Question

I seem to see a lot of different takes on this question. If I have a banned system and can I use that HDD on a unbanned box or am I better off getting a new HD and then recovering my gamer tag to the fresh unbanned BOX and HDD?

Why the banning doesnt effect the hdd, It only effects the banned console and the content it creates.
