You can, the xbox does not need to be turned on to read the NAND, just have the power cord plugged in.

In case you didn't notice most places also scan the serial number of the Xbox itself as you purchase it. This info is on the reciept. At least I know that is the case with Best Buy. (That's why there is a hole in the box showing the serial numbers!)
... yes that is the whole point of a case swap my friend. Serial stays the same.

Although my friend recently purchased the Walmart $100 Arcade console. He got 'lucky' because someone had returned it later that week and they were still doing the $100 gift cards. I had him check the serials and they matched the box. However the warranty sticker was not placed correctly and the holes on the back appeared tampered with. Looks like someone swapped the insides.

They brought it back and did not specify that it was defective. It is up to the scammer to tell them to send it back to M$.
