Nxe Playing Backup Games

Ive been trying yo figure out how the new NXE Dash is gonna handle backup games if u have your drive flashed? Do you think that if you copy a Original game to the Hard Drive and just use the backup to run it to start, the chances of being banned on xbox live are lowered?
