Only microsoft knows the answer on your question.
Your only protection is being extremely careful.
In the past microsoft is assumed to have banned people for faulty backups.
Some of the firmwares even reported bad data for using originals on live.
So the best thing is to backup all of your games on your own so that you can be sure that they are stealth.
Always using the newest firmware increases your level of safety again, all firmwares before 1.4 had the Jitterissue so update to 1.4 if you havent yet.
Using originals on live makes it a bit safer again however the 360 also check the backups and reports it when you play with a silver account so disconnect completely.
It is also possible that the 360 logs data to upload it later however this hasnt been proofed...

I just noticed that you said that you backup games from your friend if I remember well this will get you in some trouble as it is against the rules...
