I was just wondering.. if i have a xbox 360 with a flashed firmware up to date and everything..  can i still get banned if i am not playing a backup on live.. do they ban you because you are playing a burnt game? or because  they see that u have a flashed firmware.  and if i have a fully stealthed game  is it 100% safe to use on live?  

if not i want to just play my backups not for xbox live just single player.. and use the real xbox games for online.. is that safe or will i still get caught?

You should be fine the way you describe... but there is always a risk having a modded box even if it is low.
